辱罵法官鬧劇 突顯依法治國長路漫漫

隸屬國家文化部的中央芭蕾舞團因著名芭蕾舞劇《紅色娘子軍》的版權官司敗訴,法院判決舞團須向原作者賠償12萬元人民幣。這本來是一宗著作權官司,但中央芭蕾舞團卻又是在網上發聲明,又是開記者會,不僅攻擊原告「背信棄義」「詐取不義之財」,更用「劣質法官」「枉法判決」「司法腐敗」等激烈詞語,點名辱罵判案法官和法院,在內地引發輿論嘩然,在中央強調全面依法治國的今天,一個中央單位對於法院已生效的終審判決,竟然如潑婦罵街,口出惡言,令人側目之餘,亦深感中國建立法治社會還有漫漫長路要走。

這本來是一宗簡單的民事官司,《紅色娘子軍》的編劇梁信,2015年起訴中央芭蕾舞團侵犯權著作權,法院判決舞團須向梁賠償12萬元人民幣。但兩年多過去,梁信本人已離世,舞團仍未履行法院生效判決。北京市西城區法院日前裁定,梁信家人有權繼續追討,舞團須履行賠償。

敗訴的中央芭蕾舞團竟發表聲明,批評法院的判決,指摘判決是「瀆職法官的枉法判決」,聲稱「中央芭蕾舞團已淪為司法冤民,將被迫步入上訪大軍!」「堅決不向枉法裁判和司法不公屈服!堅決與危害我們社會的司法腐敗作鬥爭!」舞團召開記者會指摘梁信及家人興訟是「詐取不義之財」,是「利用媒體顛倒黑白欺騙輿論大演悲情戲」,又威脅道「法院錯誤地強制執行」判決,將使《紅色娘子軍》面臨被迫停演。
《紅色娘子軍》是在內地深入人心的著名傳統劇目,中央芭蕾舞團又是文化部直屬的國家級藝術團體,也許這就是該舞團有恃無恐、敢對法官破口大罵的原因吧。但作為一個本應屬於殿堂級的文化團體,在一宗知識產權的官司中,對法院的終審判決出言不遜,扣帽子打棍子,不僅有失國家藝術院團的水準和風度,更折射出內地一些公家單位法治意識的欠缺。

保護著作權,維護原創者的合法權益,是法治社會的基本常識。內地的文藝演出早已市場化,中央芭蕾舞團的《紅色娘子軍》也早已不是免費的義演,而且收費不低,以3年前在澳門威尼斯人劇場演出時的門票標價,最高達580港元,最低也要180港元,依法向原作者支付版權費用,乃是天經地義之事。

如此簡單的是非對錯,中央芭蕾舞團為何仍然「理曲氣壯」,這裏面有幾重因素,一是內地的法治教育不彰、法治意識不彰,遇糾紛習慣動之以情、曉之以理,卻不願訴諸法律;二是內地行政訴訟法雖已實施多年,但眾多官府單位,仍無法律面前人人平等的意識,往往聲大夾惡,仗勢壓人;三是輸打贏要,一旦敗訴,不願循法律程序上訴申訴,而是氣急敗壞,鳴冤叫屈,或拒絕履行判決,或祭出大字報、上訪等極端手段,以身抗法,甚至以權壓法。

刪帖噤聲無助法治教育 追究問責樹立法律權威

令人欣慰的是,北京的法院不為所動,繼續強制執行對中央芭蕾舞團的判決。其實,法院用兩年時間才完成如此簡單的判決,已暴露內地法院判決執行的老大難弊端。但法院執行最終不為來勢洶洶的謾罵所阻,彰顯了法治的權威。最高人民法院也轉發了題為〈蔑視法律者,舞姿再優美也會形象掃地〉的評論,作為對辱法事件的回應。

本來,中央芭蕾舞團的辱法事件在內地網上輿論的發酵,恰可作為不可多得的樣本,用來對各級政府機關乃至全國人民展開一場生動的法治教育;但令人遺憾的是,有關方面卻一聲令下,將網上的有關討論全部噤聲,是家醜不可外揚?還是為官者諱?實在令人費解。

內地法律至今仍無「藐視法庭罪」的規定,不能不說是維護司法獨立權威的一大缺陷。但社會各方尊重法院判決,是最起碼的法治底線,如果任何團體可以各種名義蔑視法庭判決,社會將倒退到叢林法則時代。

法律應當被尊重,法治應當被信仰。中央芭蕾舞團拒不執行法庭判決的義務,又用潑婦罵街方式攻擊法院和法官,對法官極盡侮辱、對司法極盡玷污的惡劣行徑,已經違反了法律。內地去年出台的《保護司法人員依法履行法定職責規定》第15條規定,法官、檢察官因依法履職遭受不實舉報、誣告陷害、利用信息網絡等方式侮辱誹謗,致使名譽受到損害的,法院、檢察院、公安機關應依法追究相關單位或者個人的責任。

中央芭蕾舞團的這篇文革大字報式的聲明,如果在網上一刪了事,沒有了下文,如果司法當局和有關方面不出聲、不作為,不僅傷了法官的心,也破壞了司法的尊嚴和權威,今後如何讓人民尊重法律、信仰法治?全面依法治國也就成了一句空話!

A vituperative attack on judges

THE NATIONAL BALLET OF CHINA under the Ministry of Culture has lost a lawsuit over the copyright of its renowned ballet, the Red Detachment of Women, and has been ordered by the court to pay the original scriptwriter 120,000 yuan in damages. But the dance troupe responded by issuing an online statement and calling a press conference. Not only did it attack the plaintiff for "going back on his word and making ill-gotten gains", but it also named the presiding judges and courts and hurled a stream of abuse at them using strong words like "inferior judges", "law-bending ruling" and "corruption of the judiciary". At a time when the central government has emphasised the full implementation of the rule of law, a central organ's vituperative and spiteful attack on an enforceable court ruling has raised eyebrows and inspired feeling that China has a long way before it becomes a society governed by law.

It all started as a simple civil case. Liang Xin, the scriptwriter of the Red Detachment of Women, sued the National Ballet for copyright infringement in 2015 and the court ordered the troupe to pay him 120,000 yuan in damages. More than two years has passed since then but the troupe has yet to comply with the order. Meanwhile, Liang has died. Recently the Xicheng District Court of Beijing ruled that his family is entitled to the sum and the troupe has to pay.

However, after losing the lawsuit, the National Ballet posted a statement which denounced the ruling as "one handed down by judges who have neglected their duty and perverted the course of justice". Claiming that "the National Ballet has become a victim of judicial injustice and has no choice but to join the army of petitioners!", the troupe said it is "determined not to bow before the law-bending ruling and judicial injustice, and is determined to fight judicial corruption which is hazardous to society!" It also called a press conference to accuse Liang Xin and his family of "making ill-gotten gains" by taking the troupe to court and "exploiting the media to confuse the rights and wrongs and putting on a gloomy face to gain public sympathy". It even threatened to cancel future performances of the Red Detachment of Women following "the court's wrongful requirement that the order must be enforced".

Supposedly a prestigious cultural organisation, the National Ballet has resorted to making insolent remarks about the final ruling on a copyright lawsuit, levelling wild accusations against the court. Not only has it failed to show the standard and demeanor expected of a national art troupe, but it has also reflected an absence of awareness of the rule of law among public organs on the mainland.

The comforting side of the story has been that the courts in Beijing remained unperturbed and went ahead with the compulsory enforcement of the order against the National Ballet. The fact that it took two years to deliver such a simple ruling has exposed the long-standing difficulties of mainland courts in the enforcement of rulings. But in the end, the court has not succumbed to the menacing abuses and got on with enforcing its order, thereby manifesting the authority of the rule of law. The Supreme People's Court also weighed in on the matter by posting an online commentary titled "Those in contempt of the law will have their reputations in tatters, no matter how beautifully they dance."

Originally, the unfolding of online discussions surrounding the National Ballet's contempt for the court can be taken as a rare opportunity to educate all ranks of public offices as well as the general public on the rule of law. But regrettably, the authorities have ordered to ban all online discussions. If the authorities simply remove the National Ballet's statement reminiscent of big-character posters during the Cultural Revolution without any follow-up action, in future how can we expect people to respect the law and have faith in the rule of law? And the call for comprehensive implementation of the rule of law will only be an empty talk!
