光誠維權本無事 當局維穩惹塵埃?

失明維權人士陳光誠在家鄉擺脫軟禁,到北京進入美國大使館,事態峰迴路轉,昨午,陳光誠在美國駐華大使駱家輝陪同下,離開大使館到朝陽醫院,除了就醫,並與家人團聚。事態發展折射出當局多年來對陳光誠的軟禁,完全無必要。此事會否真箇喜劇收場,尚待觀察,不過,事態大有「菩提本無樹,明鏡亦非台,本來無一物,何處惹塵埃」的禪機意味。
 
中方強烈批美只為面子 美方解救陳光誠贏裏子
陳光誠擺脫監視人員,逃離山東省臨沂市東師古村的家之後,內地官方未置一詞,美國方面,雖然另一名維權人士胡佳表示在美國大使館見過陳光誠,還有兩人合照證明,但是美方一直不證實陳光誠在大使館。從各種情况看來,中美不想就陳光誠事件撕破臉,保留最大操作空間,期望事件不會影響今日舉行的第6輪中美戰略與經濟對話,甚或衝擊中美整體關係大局。從陳光誠離開美國大使館的方式和中美的處理,迄今所見,表面上美國扮演了拯救陳光誠一家於水深火熱的角色,而北京當局的舉動,是否反映維穩思維有所鬆動,值得關注。
 
新華社發布稿件,由外交部發言人劉為民以答記者問方式,講述此事,措辭強硬,對美國以非正常方式將陳光誠帶入使館,表示強烈不滿,指摘美方干涉中國內政,要求美方就此道歉,徹查此事,處理相關責任人等。即使如此,迄今未見美國就此向中方道歉,而陳光誠離開大使館到醫院,由駱家輝陪同,並非由中方人員陪同而去,說明美方日後就陳光誠一家的事上,仍然扮演着一定角色。
 
另外,不透露姓名美方官員把陳光誠事件形容為「特殊個案,情况特殊,我們預期不會再發生類似事件」,相信此乃美方向中方所作出「下不為例」的承諾。事實上,內地類如陳光誠情况的人,不在少數,若往後在華美國大使館或總領事館都成為維權人士投奔之所,中美關係要經常面對這類挑戰,對兩國都無好處。不過,陳光誠因為「美國因素」,得到安全和自由,其他維權人士仿效,美方可以斷然拒絕?看來要有真實事件發生,美方的承諾才得以驗證。
 
在陳光誠此事上,單看官方文字,劉為民好像把美方駡了一頓,美國則不作口舌之爭,只透露中方承諾可讓陳光誠修讀大學課程,美方可定期探望他等。從已披露資料看來,在此事上,中方只為面子而批評美國,美方則贏得裏子,履行保護人權之名。
 
按中美雙方迄今說法,陳光誠進入美國大使館前後,在內地當局的「名單」中,成為兩個截然不同的人。在進入美國大使館之前,他在東師古村家鄉,被軟禁家中,全天候受到監視,他訴說與家人屢遭監視人員暴力對待和毆打,即使受傷也不能送醫治理,呈現出一副當局無法無天,陳光誠一家過着暗無天日生活的景象;他進入使館之後,起碼他得到安全之所,日後還有機會過自由生活,入讀大學,好像光明在望了。
陳光誠本來是當局重點維穩對象,現在,陳光誠還是陳光誠,他把事態捅到美國大使館,成為國際事件,使內地當局更面目無光,即使如此,陳光誠對於內地當局,「突然」成為一個完全的「好人」,得到充分照顧。他的遭遇是否太「神奇」了?
 
陳光誠命運的轉變,或許可以說明過往當局視他如「寇讎」,以龐大人力物力對付,根本就無必要。陳光誠本來就不是什麼「敵人」,即使當局認為他衝擊計劃生育,構成罪行,但他已服刑出獄,當局卻違憲違法地把他軟禁起來,事態反而是因為當局的心魔而起,以維穩手法搞得他投奔美國大使館,使國家丟臉。這就是「光誠維權本無事,當局維權惹塵埃」的意思。
 
期望維穩體制出現鬆動 切勿老羞成怒加強控制
在內地,陳光誠事件並非孤例,不少省市都有類似「維穩」重點對象,較知名者北京有胡佳、艾未未,上海有馮正虎等,陳光誠事件會否給「維穩」帶來新局面,尚待觀察。按劉為民說,「中方強調,中國是法治國家,任何公民的合法權益都受憲法和法律保護。」中共若真正保護公民的合法權益,就應該如陳光誠一樣,撤除對其他維權人士的不合法、不合理監控,以實際行動體現依法治國。可是,現在有更多人擔心,陳光誠事件不僅不可能改變維穩體制,反而可能會刺激官方進一步加強網絡審查維穩,超法制的強制或暴力也因此會運用得更加廣泛和肆無忌憚。但願這個擔心過慮了。期望內地人權狀況,朝好的方向發展,而非向更壞的軌道滑下去,不然的話,類似陳光誠事件必會捲土重來。
The Chen Guangcheng Incident
 
BLIND human rights activist Chen Guangcheng escaped from house arrest in his hometown and fled to the US embassy in Beijing. Then, yesterday afternoon, things took an abrupt turn. He left the embassy, and was escorted by US ambassador Gary Locke to the Chaoyang Hospital for treatment and reunion with his family.

In the several days following Chen's escape from his guarded home in Dongshigu village, Linyi, Shandong, the Chinese authorities made no comments, and the US refused to confirm Chen's whereabouts. Apparently, both China and the US do not want to fall out with each other over the Chen incident, hoping that the sixth round of the China-US Strategic and Economic Dialogue to be held today will not be affected, and more importantly the two countries' overall relations will not suffer.

According to a news report released by the Xinhua News Agency yesterday, Chinese Foreign Ministry spokesman Liu Weimin was answering reporters' questions when he talked about the incident. In very strong terms, he expressed great dissatisfaction with the US for improperly taking Chen into its embassy, and, as he demanded an apology from the US for interfering in China's domestic affairs, said the US must look into the matter thoroughly and discipline the culprits. The US, however, has up to this moment not offered any apology, and the US ambassador even went to the hospital with Chen, which seems to show that the US will continue to play a part in matters related to the Chen family in future.

So, from what has been released officially, it appears that Liu Weimin has given the US a severe dressing down, while the US is not getting into a verbal battle, but has simply pointed out that the Chinese authorities have undertaken to allow Chen to pursue higher education, and that US officials may visit him regularly. Judging by what has been disclosed so far, it is apparent that China's criticism against the US is but a face-saving gesture, while the US has the real satisfaction of being seen as a protector of human rights.

According to what the Chinese and American officials have so far said, the Chinese authorities seem to see Chen in an entirely new light after his entry into the US embassy. Before his entry, Chen was under house arrest in Dongshigu village, where he was closely guarded twenty-four hours a day, and as he said he and his family were frequently beaten and treated with violence, and were not allowed to go to hospital for bodily injuries suffered. But after his entry into the embassy, he has at least been promised safety. He may now even live in freedom and go to university. A bright future seems to be in store for him.

The way Chen is now treated may serve to show that there was in fact no call for the authorities to regard him as an "undesirable". He was no "enemy", and would not have sought refuge in the US embassy and brought disgrace on China if the authorities had not put him under house arrest in violation of the constitution and the law.

According to Liu Weimin, "the Chinese government stresses that China is governed by the rule of law, and the legal rights of all citizens are safeguarded by the constitution and the law." If the Chinese Communist Party really cares about the people's legal rights, it should take concrete steps to ensure that China is governed according to the law, otherwise cases similar to the Chen incident are bound to occur again in future.
